Per the most recent executive actions put forth by the White House, immigration policy will be impacted in a variety of ways, including:

  • Modifying requirements, resulting in a greater number of people being eligible for the Deferred Action for Childhood Arrivals (DACA) program…individuals coming to the U.S. prior to their 16th birthday and who have been here since 1/1/2010 will have DACA and work authorization increased from two years to three years
  • Allowing parents of U.S. citizens and permanent residents who have been in the country since 1/1/2010 to request a deferment in action taken against them, as well as employment authorization for three years (provided they pass background checks) as part of a new Deferred Action for Parental Accountability program
  • Expanding use of provisional waivers of unlawful presence to include spouses and children of permanent residents as well as the children of U.S. citizens
